These Terms of Service govern your use of the websites operated by Holistic Hyperbarics Inc. ("Holistic Hyperbarics," "we," "us," or "our"), including hh-bayarea.com and offers.hh-bayarea.com (the "Sites"). By using the Sites or submitting a form on them, you agree to these Terms. If you do not agree, please do not use the Sites.
Section 14 requires most disputes about these Sites to be resolved individually, in arbitration, rather than in court or as part of a class action. It does not apply to claims about your medical care.
1. The Sites are informational — they are not medical advice
Nothing on these Sites is medical advice, diagnosis, or treatment. The content is general information about hyperbaric oxygen therapy and related services. It is not a substitute for consultation with a qualified healthcare provider, and you should never disregard or delay seeking professional medical advice because of something you read here.
Using the Sites, reading our content, submitting a form, or requesting a consultation does not create a physician–patient or provider–patient relationship. That relationship begins only when you are formally accepted as a patient and complete our intake and evaluation process in our clinic.

2. Consultation requests
A form submitted through the Sites is a request for a phone consultation. It is not a booked appointment, and it is not an agreement by us to accept you as a patient or to provide any treatment.
Hyperbaric oxygen therapy is appropriate for some conditions and not others, and is not appropriate for every person who has a given condition. Whether we can help you is determined through consultation and clinical evaluation, and we may decline to accept a person as a patient where treatment would not be appropriate.
3. No guarantee of outcomes or of insurance coverage
We make no promise or guarantee about the results of any treatment. Individual results vary, and any studies, testimonials, or outcomes described on the Sites reflect specific circumstances that may not resemble yours.
Some conditions treated with hyperbaric oxygen therapy are covered by some health plans. We cannot and do not guarantee that your treatment will be covered, that a benefits check will produce a particular result, or that a payer will not later deny or reverse a claim. Coverage decisions rest with your insurer and depend on your specific plan, your diagnosis, your documentation, and your insurer's own criteria. Any statement we make about likely coverage is an estimate, not a commitment, and you remain responsible for charges your plan does not pay.
4. Clinic policies
If you become a patient, our clinic policies apply to your care and are incorporated into these Terms by reference. These cover packages, payment, cancellation, cards on file, and treatment of clients under 18, and include a 24-hour cancellation policy and a non-refundable package policy. 5. Electronic communications
By providing your contact information, you consent to receive communications from us electronically — by email and, where you have given text-message consent, by SMS. Message frequency varies and message and data rates may apply. Reply STOP to opt out of texts or HELP for assistance. Marketing consent is optional and is never required to receive care. 6. Do not send sensitive information through the Sites
Please do not submit diagnoses, symptoms, medical history, insurance identifiers, or other sensitive information through the general forms or by unsecured email. When we need clinical information, we will direct you to a secure intake form or collect it by phone or in person.
7. Acceptable use
You agree not to:
- Use the Sites for any unlawful purpose or in violation of these Terms
- Attempt to gain unauthorized access to the Sites or any related system
- Interfere with the operation or security of the Sites
- Scrape, harvest, or collect data from the Sites by automated means without our written permission
- Submit false information or impersonate another person
8. Intellectual property
The content on the Sites — text, graphics, logos, photographs, and layout — is owned by Holistic Hyperbarics Inc. or its licensors and is protected by copyright and trademark law. You may view and print pages for your own personal, non-commercial use. Any other reproduction, distribution, or modification requires our prior written permission.
9. Third-party links and services
The Sites link to third-party websites, including published research and scheduling and intake tools operated by other companies. We do not control those sites and are not responsible for their content, availability, or practices. Your use of a third-party service is governed by that provider's own terms and privacy policy.
10. Disclaimer of warranties
The Sites and their content are provided "as is" and "as available," without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Sites will be uninterrupted, error-free, or free of harmful components, or that the information on them is complete or current.
11. Limitation of liability
To the fullest extent permitted by law, Holistic Hyperbarics Inc. and its owners, officers, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or lost data, arising out of or relating to your use of the Sites — even if we have been advised of the possibility of such damages. Our total liability for any claim relating to the Sites will not exceed one hundred dollars ($100).
Nothing in these Terms limits liability that cannot be limited under applicable law, and nothing here limits or affects any rights or claims arising from the professional care we provide to patients, which are governed by California law rather than by these website Terms.
12. Indemnification
You agree to indemnify and hold harmless Holistic Hyperbarics Inc. from any claims, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of your misuse of the Sites or your violation of these Terms or of applicable law.
13. Governing law
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Subject to Section 14, any dispute not resolved in arbitration will be brought exclusively in the state or federal courts located in Alameda County, California, and you consent to the jurisdiction of those courts.
14. Dispute resolution, arbitration, and class action waiver
Please read this section carefully. It requires most disputes about these Sites to be resolved individually, in arbitration, rather than in court or as part of a class action. It does not apply to claims about your medical care.
14.1 What this section covers — and what it does not
This Section 14 applies to disputes arising out of or relating to the Sites, our marketing and advertising, our website technologies, our electronic communications with you, and these Terms.
This Section 14 does not apply to, and expressly excludes, any claim arising out of or relating to professional medical care, treatment, diagnosis, or clinical services provided by Holistic Hyperbarics Inc. or its personnel. Those claims are not subject to this arbitration agreement. If we and a patient agree to arbitrate care-related claims, that will be done through a separate written agreement signed at intake that complies with California Code of Civil Procedure section 1295.
14.2 Informal resolution first
Before starting an arbitration, you agree to contact us at info@hh-usa.com and describe the dispute and the relief you are seeking, and to give us 60 days to try to resolve it informally. We agree to do the same before bringing a claim against you. This step is a condition of starting an arbitration, and the time to bring a claim is paused while it runs.
14.3 Agreement to arbitrate
If informal resolution does not work, you and we agree that any covered dispute will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, which are incorporated here by reference. The arbitration will take place in Alameda County, California, or by videoconference or on the documents alone if you prefer. The arbitrator may award the same individual relief a court could. Arbitration fees are allocated in accordance with the applicable AAA rules.
14.4 Class action waiver
You and we each agree to bring claims only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding. The arbitrator may not consolidate more than one person's claims or preside over any form of representative or class proceeding. If this waiver is found unenforceable as to a particular claim or a particular form of relief, then that claim or that request for relief — and only that one — will be severed from the arbitration and brought in the courts identified in Section 13, and the remainder of this Section 14 will continue to apply.
14.5 Exceptions
Either of us may bring an individual claim in small claims court if it qualifies, and either of us may seek injunctive relief in court to protect intellectual property or to stop unauthorized access to the Sites. Nothing here prevents you from reporting a concern to a government agency.
14.6 Survival
This Section 14 survives termination of these Terms and your use of the Sites.
15. Changes to these Terms
We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Your continued use of the Sites after a change takes effect means you accept the revised Terms.
16. Severability and entire agreement
If any provision of these Terms is found unenforceable, the remaining provisions stay in effect. These Terms, together with our Privacy Policy and, where applicable, our clinic policies and Notice of Privacy Practices, are the entire agreement between you and us regarding the Sites.
